Ashton man charged with malicious wounding

ASHTON — An Ashton man has been arrested and charged with malicious wounding after he allegedly struck another man with a baseball bat.

Kevin L. Smith, 50, 29 Shad Lane, Ashton, was arrested Monday by personnel with the Mason County Sheriff’s Department. He appeared in Mason County Magistrate Court for arraignment, where his bond has been set at $50,000. As of Wednesday evening, he remained housed at the Western Regional Jail.

According to the official criminal complaint filed in magistrate court, Smith allegedly got into a physical altercation with his brother, Marshall Smith, age and address unreported, at a residence located at 29 Shad Lane in the Ashton area.

After the initial physical altercation had taken place, Kevin allegedly went inside of his residence and obtained a Louisville pro baseball bat. Kevin then went back outside from the residence where he allegedly ended up striking Marshall with the bat, according to the complaint.

Marshall was transported to St. Mary’s Medical Center for treatment of his injuries. Sgt. T. L. Powell is the arresting officer in this case, which remains under investigation. There was no reason for the initial altercation listed on the complaint.

In other news from the Mason County Sheriff’s Department, the following arrests have been reported in unrelated cases: David W. Johnson, 48, Gallipolis, Ohio, capias, arrested by Lt. Greene. Phillip S. Smith, 31, Pomeroy, Ohio, fleeing on foot, no insurance, driving on revoked for DUI, arrested by Deputy M. Stewart. Burton J. Garnes, 35, Evans, cultivation of marijuana, arrested by Deputy Johnson.
