POINT PLEASANT — A former Mason firefighter will have to wait until June to find out how much time he will spend in prison.
Brent Donovan Kapp of Mason appeared before Judge David Nibert Thursday in Mason County Circuit Court for sentencing after entering two guilty pleas for arson.
He is facing up to 30 years in a West Virginia penitentiary. He must serve at least two years on the first-degree charge before being considered for parole.
Prosecuting Attorney Damon Morgan asked for the continuance, saying that additional time was needed because conditions were not in proper posture for the sentencing.
Per a plea agreement entered Feb. 25, Kapp agreed to enter a guilty plea for first-degree arson and second-degree arson for at least two fires with which he was involved in the Mason Volunteer Fire Department’s coverage district. Kapp, along with two others, allegedly set fires to at least two structures.
He will be sentenced June 1.
• Derek T. Jackson was sentenced to six months in the Western Regional Jail with credit for time served after he entered a guilty plea of destruction of property. Jackson’s attorney, Craig Tatterson, asked Nibert if his client can serve the sentence on home confinement and the Day Report Center.
Nibert agreed and also ordered Jackson to pay restitution.
• Robert Craig Johnson of Racine, Ohio, entered a guilty plea for burglary. He faces a sentence of 1-15 years in a West Virginia penitentiary.
Johnson will be sentenced June 1.
• Nibert denied a motion by Christopher L. Sturgeon’s attorney, Kevin Hughart, who asked that the charges against his client by dismissed. Sturgeon, of Apple Grove, along with John Franklin Hill of Gallipolis Ferry, was indicted for grand larceny and conspiracy after allegedly taking items belonging to Valley Volunteer Fire Department.
Nibert denied the motion and set a trial date for June 9.
• Larry David Willcoxen entered guilty pleas to burglary and attempted burglary of two Point Pleasant homes in August 2008. He faces a sentence of 1-15 years for burglary and 1-3 years in a West Virginia penitentiary or six months to one year and a $500 fine in the regional jail for attempted burglary. He will be sentenced June 1.
Joshua Strehle faces a prison term of 45 years after he entered a plea of guilty Tuesday to three counts of burglary. Another person, Melissa Stover, also is facing hearings in the matter. Strehle’s sister was not involved in the alleged criminal actions as previously reported.
• Larry Michael Hersman entered a guilty plea for conspiracy on information. He faces a penalty of 1-5 years in a West Virginia penitentiary and up to a $10,000 fine.
In April 2008, following an investigation by the New Haven Police Department, Hersman, along with at least three others, was arrested for grand larceny for allegedly taking steel from Kimes Steel in New Haven.
He will be sentenced June 1.
• Brandon Floyd was sentenced to 1-15 years in prison for burglary and one year in jail for petit larceny that will run concurrent with his current sentence of at least eight years in an Ohio penitentiary.
