Grand jury meets: 38 indicted, including Richard Hurt, Sr.


POINT PLEASANT — A Mason County Grand Jury met for the third and final time this year on Tuesday and Wednesday, returning 41 indictments.

Included in those indictments, was Richard Allen Hurt, Sr., 48, Gallipolis, Ohio, for concealment of a deceased human body. Hurt was sentenced in February by the Gallia County Court of Common Pleas to four years in a state facility after he pleaded guilty in February to the act of dismembering Gallia resident Jessica Berry in 2016. In Mason County, Hurt is accused of carrying Berry’s remains over state lines and into West Virginia, where he buried them at a residence outside Point Pleasant.

As previously reported, in Gallia County, Hurt pleaded guilty of his own accord with no plea arrangement offered to the third-degree felony of tampering with evidence and the fifth-degree crime of abuse of a corpse. Hurt was sentenced to three years for the third-degree felony and one year for the fifth-degree felony with sentences to run consecutively by Gallia Common Pleas Judge Margaret Evans. In accordance with Ohio Revised Code stipulations, and what Evans felt were issues previously handled in the Gallipolis Municipal Court, Judge Evans sentenced Hurt to the full term of four years in prison as well as post release control stipulations.

In addition to Hurt, the following persons indicted by the September 2017 Term of Grand Jury are to appear in the Circuit Court of Mason County on Thursday, Sept. 7, at 9 a.m., according to the office of Mason County Prosecuting Attorney R.F. Stein, Jr.:

Joy D. Black, 48, West Columbia, access device fraud times 45. Michael Ray Clark, 44, Fayette, grand larceny; breaking and entering an automobile; petit larceny. Gregory S. Lee, 28, Pomeroy, Ohio, access device fraud times three; attempted access device fraud times two; conspiracy times five. Larry T. Huffman, 54, Letart, driving while revoked, DUI related, third or subsequent offense. John Cunningham, 34, Leon, failure to register as a sex offender times three. Jody Thomas Stewart, 28, New Haven, transferring stolen goods. Anthony Darrell Black, 29, Point Pleasant, entry of a building other than a dwelling; destruction of property; conspiracy; breaking and entering an automobile times four; petit larceny times four; grand larceny.

Travis Johnson, 27, Point Pleasant, entry of a building other than a dwelling; conspiracy. Perry Baker, 69, Milton, malicious assault; prohibited person in possession of a firearm. Curtis Joe Kimble, age unreported, Milton, attempt to commit a felony. Andrew S. Dowler, 22, Point Pleasant, attempt to commit a felony; destruction of property; burglary. Andrew S. Dowler, 22, Point Pleasant, escape; destruction of property. Adam Boggess, 41, Middleport, Ohio, shoplifting, third or subsequent offense; trespassing. Adam Boggess, 41, Middleport, Ohio, sexual assault in the first degree. Billy Bowman, 41, Point Pleasant, burglary; malicious assault; prohibited person in possession of a firearm. Benjamin Lucas Boster, 37, Southside, child abuse resulting in bodily injury. Amanda Chafin, 35, Gallipolis, Ohio, possession of a controlled substance with intent to deliver times two; conspiracy times two. Theron Smith, 39, Dayton, Ohio, possession of a controlled substance with intent to deliver times two; battery on a law enforcement officer; conspiracy times two. Tyler J. Hesson, 37, Mason, possession of a controlled substance with intent to deliver.

Bradley Scott Igo, 48, Leon, fleeing in a vehicle from a law enforcement officer; aggravated driving under the influence. William Roush, 40, West Columbia, prohibited person in possession of a firearm. Carla Jo Smith, 45, Leon, forgery times six; uttering times six. James Edward Jones, III, 31, Point Pleasant, fraudulent scheme times three. Steven Lee Darst, age unreported, Mason, failure to register as a sex offender. Carolyn Irene Davis, 66, Point Pleasant, child neglect resulting in death. Christopher David Berkley, 47, Gallipolis Ferry, operate or attempt to operate a clandestine drug laboratory; manufacture a controlled substance. Derek Ray Riffle, 34, Point Pleasant, child neglect creating risk of death or serious injury; driving under the influence, second offense. Denessa Stewart, 30, Middleport, Ohio, forgery times two; uttering; attempt to commit a felony. Jonathan Arthur Brodie, 29, Henderson, N.C., grand larceny.

Jerry DeWayne Carroll, Jr., 36, Southside, sexual assault in the first degree times two; sexual abuse in the first degree times two; attempt to commit sexual assault in the first degree times two. Denver Kyle Saunders, 35, Glenwood, escape. Daniel R. Plants, II, 43, Henderson, use of a minor in filming sexually explicit conduct times 12; sexual abuse by custodian times 17; sexual abuse in the third degree times five; possession of child erotica; contributing to delinquency of a child times three. Daniel R. Plants, II, 43, Henderson, sexual assault in the first degree times 10. Jack Carson Dewitt, 40, Henderson, burglary; assault; battery on a law enforcement officer times two; obstructing an officer times two. James Orville Edwards, 31, Gallipolis, Ohio, malicious assault; breaking and entering; petit larceny.

Jerold Allen Fugate, 55, Milton, malicious assault; domestic battery. Shawn M. Gibbs, 29, Hartford, possession of a controlled substance with intent to deliver.
