MASON COUNTY — Sentencing of a former instructor at the Lakin Correctional Facility was to take place on Thursday but due to Judge David W. Nibert becoming ill, the sentencing has been delayed.
Standley Greene, 44, Charleston, was to be sentenced after pleading guilty to the felony offense of sexual imposition on incarcerated person. Greene’s sentencing has been rescheduled for 2 p.m., Feb. 7 in Mason County Circuit Court. Despite being ill, Judge Nibert did hear several other cases on Thursday (see “For the Record” on page one), the majority of these cases being those who received grand jury indictments this week.
Greene was indicted by a Mason County Grand Jury last January on a felony charge of sexual imposition on incarcerated person. Greene initially pleaded not guilty and posted a $5,000 bond for his release. His trial was set to start June 5, 2012. Then, on June 6, 2012, Greene entered into a plea agreement with the state, pleading guilty to the felony offense of sexual imposition on incarcerated person.
The indictment alleged while he was working at the Lakin facility in the capacity of an educator, he engaged in sexual intercourse with a female inmate, specifically between the hours of 10:15 a.m. to 11 a.m., Aug. 22, 2008, at the Lakin Correctional Facility. Greene was the former head of the educational program at the prison.
Greene was arrested back in 2008 on the charge by the Mason County Post of the West Virginia State Police. The processing of DNA evidence is believed to have at least played a part in the delay between Greene’s arrest in 2008 and indictment in 2012. Greene is no longer an employee of the Lakin Correctional Facility, and though initially suspended from his job after his 2008 arrest, he was reportedly fired following an internal investigation.
As for the victim, last year, a Charleston newspaper reported she sued the state’s insurance carrier and settled for $250,000.
Prior to sentencing, orders for a customary pre-sentencing report and recommendations, as well as a psychological evaluation were listed in the case docket.
Greene is being represented by attorney William Forbes of Charleston.
