POINT PLEASANT — A Milton woman has won a civil case against American Electric Power after she claimed she was injured while working as a cook on the MV Capt. John Reynolds.

The civil trial of Linda K. Gillispie, Milton, vs. Indiana Michigan Power Company, dba, AEP, recently took place in Mason County Circuit Court with a jury awarding Gillispie $150,213.93 in damages.

In the initial complaint filed by Gillispie in May of 2010, she and her counsel allege on Oct. 2, 2009 she was working as a cook on the M/V Capt. John Reynolds on the Ohio River when she suffered damage to her left ankle, hip, back and neck due to negligence on the part of Indiana Michigan.

Gillispie’s complaint alleges Indiana Michigan was negligent in one or more of the following respects: failed to provide her with a reasonably safe place to work; failed to provide her with adequate assistance in the performance of her duties; failed to warn her of the dangers in the area she was assigned to work; failed to supervise the work being performed; failed to provide her with adequate equipment to safely perform the tasks assigned to her.

According to the verdict form, the jury found damages totaling $176,722.26 which included $1,322.26 for medical expenses incurred, $125,400 for lost wages, $50,000 in pain and suffering.

In accordance with the jury’s finding regarding the comparative degrees of negligence or fault between the parties, jury members found Indiana Michigan 85 percent at fault and Gillispie 15 percent at fault for Gillispie’s injuries. This meant, Gillispie’s percentage of the $176,722.26 was reduced 15 percent ($26,508.33), leaving her entitled to the $150,213.93.
