ONA — A former Mason County Sheriff has been arrested in Cabell County.

Delvin “Scott” Simms, 56, Ona, was charged with DUI first offense and speeding after a traffic stop on U.S. Rt. 60 on Aug. 24, according to criminal complaints filed in Cabell County Magistrate Court.

The complaint says a truck driven by Simms pulled out from a closed business in the 3200 block of U.S. Rt. 60 in an “aggressive manner.” The officer stated the truck was going around 60 mph in a 45 mph zone. In addition, the officer wrote the truck swerved over the white line four times within about a mile.

The criminal complaint also states Simms failed all three Standard Field Sobriety Tests and was unable to give a sufficient sample on the Preliminary Breath Test.

Simms was transported to the Western Regional Jail and later appeared before a Cabell County Magistrate. Simms was released on a $3,100 bond.
